Ownership in Stateless Places

In this chapter, I revisit the intellectual history of the parent property to underscore the difficulties of disembedding it. I then turn to the twin dilemmas of state perishability and state perfidy. Together, they give readers critical distance on the state-property nexus and challenge its indelible nature. Next, I survey the growing storefront of non-state spaces (or 'counterpaces') in support of the claim that state-centric property overdetermines common conceptions of property. The final section returns to our originating question, answers it in the negative, and points to non-state-property precedents in concluding that diverse social organisations – not just nation states – sanction and protect property.
