Service Member's Request for Stay on Billing and Collection
This template service is provided by the Law Office of Christopher Dort and is intended for self help use to Request a Stay of any California finance contract or bill, or other civil liability on the Basis of Active Military Service.
The request is for a stay of all billing and collection activity until the period of active duty ends plus 3 months as allowed by law. For example, this template could be used to request a stay of all credit card billing, interest charges and collection activity duty active duty service plus 3 months.
It is made on the basis of California's Military and Veterans Code section 401, which requires a stay when Active Military Service interferers with a Service Member's ability to pay or perform a contract. Use this template as is, or edit to your own needs.
The request can be made in writing by the service member or any representative for him/her who knows the service details. It is for use by service members with a permanent address in California, or with contracts with CA companies.
