Notice of No Speedy Trial Waiver
This document is a formal Notice to the California Traffic Court that the Defendant DOES NOT WAIVE their RIGHT TO A SPEEDY TRIAL.
This is a formal court Notice that comes on pleading paper and complies with required court rules. It is effective written notice to the court once filed with the court.
This form is written by a licensed Defense Attorney and is intended to prevent an acciental or inadvertant loss of the right to trial by waiver. It is also designed to be the foundation of a Motion to Dismiss for Violation of Right to Speedy Trial if the court is unable to provide a speedy trial.
"I wrote this form to help the everyday defendant on a traffic ticket who wants to have their right to a trial before memories fade, witnesses move, or the CHP destroys the dashcam video. It is the exact Notice I would use in a criminal or traffic court case if my client did not want to waive their right to a speedy trial - or as the courts call it - 'waive time' . . . There is no shame in demanding your right to a speedy trial. Dont let a court take it away without your explicit consent." - Attorney Christopher Dort
